1. Acceptance of Terms

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 77TAYA, ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF 77TAYA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL 77TAYA'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE TOTAL AMOUNT OF DEPOSITS MADE BY YOU TO YOUR ACCOUNT DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED PHILIPPINE PESOS (₱100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless 77taya, its parent companies, subsidiaries, affiliates, directors, officers, employees, agents, partners, licensors, suppliers, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees and legal costs) arising from: (a) your use of or access to the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; (d) any false or fraudulent information provided during registration or verification; or (e) any other conduct or activity undertaken using your 77taya account.

13. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to your use of 77taya services shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
